This may or may not help; but, I have been advised by UC San Francisco's
Committee on Human Research that we can get something called a certificate
of confidentiality from the NIH that will protect our records from
subpoenas.

Haven't seen any formal statement on this, but Westat's lawyer felt the
terms would protect against subpoenas.  Suggest you check with Kathy
Browning, at 202-305-4512, OJJDP's specialist on this topic.  She's likely
to know the answers, or know where to go to get the answers.

Has anyone seen a legal memo prepared by someone, for example, a University
attorney, to evaluate the question of how the Department of Justice's
privacy certificate operates for researchers in the face of state and local
legal mandates, including subpoenas and mandatory child abuse reporting
requirements.

My IRB is seeking a legal opinion from our University counsel on this
matter, and I wanted to see if someone had already done an analysis that
might help her out.
