Research design question

I am a clinician trying to think like a researcher - (humbled by the
transition). I could really use some help with thinking thorugh this
research design. I am doing some research on non offending mother's of
sexually abused children. The literature review is pretty clear that most
mothers do not know nor do they collude with the offender. Twqenty five
years of Clinical experience (with mothers, children and sex offenders)
Leads me to believe that if chidlren do express their distress, mothers
misread the signals - interpret the behavior to mean something else. The
research will be using a sample of mothers who believed the allegations
whether they heard it from the child or anyone else) - no more than 6
months post disclosure. I am interested in learning whether they recognized
concerning behaviors while the child was being moleted, and what they
thought the behavior meant. I have developed a questionairre that addresses
these issues. The two insturments most commonly used to assess children's
behavior post disclosure are the CSBI and the CBCL.Both are self report
insturments given to the caregivers. I was considering asking the mothers to
complete those insturments first, essentially to refresh their memories
regarding possible behavioral indicators. I am not necessarily interested in
scoring the test as I am only interested in what they thought the behaviors
meant. Here is my questions?
1. Can I (legally) just use the questions from the tests - the 38 items from
the CSBI and questions from the interalizing-externalizing scales of the
CBCL? If I don't score them is that copyright infringement?
2. What problems do you see with this design?
