California is one state that, at least for referrals for men on probation for battering their partners, makes it illegal to have couples therapy in a domestic violence treatment program. However, non-probation referrals to couples treatment can and sometimes are allowed (depending on the county). In general, it seems that the current standards are to discourage couples treatment until such time as the batterer takes responsibility for his behavior and demonstrates progress after having obtained some modicum of treatment. Again, though, at least in California, if its a probation referral, couples therapy would not be permitted.
