Re: Researchers as mandated reporters -Reply
I just want to call attention to one other element that may become
involved in the child abuse reporting process. That is, California, and
I presume some other states, defines the reporting duties as
"individual," and limits administrative involvement in the process.
Also, I see no reference to researchers as mandated reporters in the
Code. Therefore, it seems to me this part of the Code would not apply
in research situation.
For your information:
California Penal Code Section 11166 (h).
"The reporting duties under this section are individual, and no
supervisor or administrator may impede or inhibit the reporting
duties, and no person making a report shall be subject to any
sanction for making the report. However, internal procedures to
facilitate reporting and apprise supervisors and administrators of
reports may be established provided that they are not inconsistent
with this article.
The internal procedures shall not require any employee required to
make reports pursuant to this article to disclose his or her
identity to the employer."
