You really have to look at the law of your state for the list of mandated
reporters. The law in NY state says something like a mandated reporter
"acting in a professional capacity." I take it that means that as a
mandated reporter you don't have to make reports (although you may) in
your capacity as an ordinary citizen. NY also doesn't require that the
professional actulaly see the child. Your state may require the
professional to see the child. There is no answer to your quesiton
without checking the details of your state's law. Murray Levine
